1. Introduction
This Cancellation Policy governs the circumstances in which a Client may cancel a pending transaction or its account upon the Abhita Verification Portal operated by Abhita Land Solutions Private Limited (the “Company”), and is to be read together with the Company’s Terms and Conditions and Refund Policy, each of which is incorporated herein by reference.
2. Cancellation of a Credit Top-Up Prior to Payment Completion
A Client that has initiated a credit top-up but has not yet completed payment upon the secure payment page of the Company’s payment aggregator, ICICI Bank Limited, may abandon or cancel such transaction at any point prior to authorising the payment, without any charge whatsoever being levied. Where a Client closes the payment page or allows the payment session to lapse without completing authorisation, no consideration shall be debited and no credits shall be allocated, and the transaction shall be automatically recorded as cancelled or failed upon the Company’s systems.
3. No Cancellation Once Payment Is Successfully Authorised
Once a Client has successfully authorised a payment for the purchase of credits, whether by entry of a one time password, personal identification number, or other authentication factor required by the issuing bank, the underlying transaction shall be deemed complete and irrevocable, and the corresponding credits shall be allocated to the Client’s wallet. A Client may not thereafter cancel such a completed top-up transaction, save that the Client may, in the circumstances and subject to the conditions set out in the Company’s Refund Policy, seek a refund of any unutilised credit balance upon lawful termination of its account.
4. No Cancellation of an Individual Verification Request
By reason of the instantaneous and irreversible nature of the underlying technical process, a Client may not cancel an individual verification request once the same has been submitted and the corresponding credit debited, it being technically impossible for the Company to recall a query already transmitted to the relevant third party verification data source. A Client is accordingly advised to exercise due care in reviewing the identifying particulars entered prior to submitting any verification request.
5. Cancellation or Withdrawal of a Pending Registration Application
A prospective Client whose application for registration is pending approval by the Company may, at any time prior to such approval, request withdrawal of its application by writing to the Company at support@abhitaeservices.com, whereupon the application shall be withdrawn and no further processing thereof shall occur. No consideration is payable at the stage of registration, and accordingly no refund arises upon such withdrawal.
6. Voluntary Closure of Account by a Client
A Client wishing to voluntarily close its account may submit a written request to the Company at support@abhitaeservices.com. Upon confirmation of the Client’s identity and authority to make such request, the Company shall deactivate the Client’s account within a reasonable period, and shall deal with any unutilised credit balance in accordance with Clause 3 of the Refund Policy, it being clarified that a voluntary closure initiated by the Client for reasons of its own convenience shall be treated on the same footing as termination not attributable to breach by the Client, for the limited purpose of unutilised credit refund.
7. Cancellation by the Company
The Company reserves the right to cancel or decline to process any pending transaction, or to suspend or terminate a Client’s account, in the circumstances set out in Clause 11 of the Terms and Conditions, including on account of reasonable suspicion of fraud, breach of the Terms and Conditions, or a requirement imposed by law or by a regulatory or judicial authority.
